A Senior Magistrates’ Court sitting in Kano, on Wednesday, ordered the remand of Alhassan Ado-Doguwa, member representing Doguwa/Tudun Wada Federal Constituency over alleged murder during the Feb.25, presidential election.
Ado-Doguwa alongside Bashir Dahiru, are standing trial on a six-count charge bordering on criminal conspiracy, culpable homicide, causing grievous hurt, mischief by fire, inciting disturbance and unlawful possession of firearms.
The prosecutor, Mrs. Aisha Salisu, told the court that the defendants committed the offence on Feb.26, at Tudun Wada Dankadai, Dawakin Kudi Local Government Kano.
She alleged that on the same date the first defendant Doguwa, used a gun and shot one Ibrahim Dauda to death and injured two persons on their legs and hand.
“The defendants conspired with five others now at large and conducted themselves in a manner to cause breach of public peace and burnt the office of the New Nigeria Peoples Party (NNPP) in Tudun Wada Dankadai.
“Two persons lost their lives at the said NNPP office, while six persons sustained various injuries.”
The prosecutor urged the court not to admit the defendants to bail, for public peace, tranquility and in the interest of Justice.
“Any person accused of committing capital offence which attracts severe punishment cannot be granted bail,” he said.
The offence contravened the provisions of section 97, 221, 114, 247 and 336 of the Penal Code and 27(a)(b)(I) of the firearms act.
The plea of the defendant was not taken.
The defense counsel, Mr. Abdul Adamu, urged the court to admit the defendants to bail pursuant to section 35, 36 of the 1999 Constitution of the Federal Republic of Nigeria as amended and 171 of the Administration of Criminal Justice Law 2019.
“The first defendant is a public domain figure and majority leader of the House of Reps,” he said.
Senior Magistrate Ibrahim Mansur-Yola ordered the remand of the defendant in Goron Dutse Kano Correctional Center.
He adjourned the matter until March 7, for ruling on bail application.
