Court fixes hearing on Godsidi Investments vs Access Bank case

Justice Young Agola of the Bayelsa State High Court sitting in Yenagoa, has adjourned sitting to 12th April and 2nd May 2017 on the case between Godsidi Investments Limited and Access Bank over illegal withdrawal of N151, 810,932.19 kobo from the claimant’s account.

The claimant, Godsidi Investment Limited had approached the court over the non authorization of withdrawal from his account by the management of the bank and therefore is seeking compensation  of N3 billion from the defendant.

The Judge after hearing the cross examination by the counsel to the Defendant, C.B.Sigalo adjourned and fixed  12th April and 2nd May, 2017 for further cross examination.

Presiding over the case on Wednesday at Court 8, State High Court before it was adjourned, Justice Young Agola said, he had not seen any representatives of Access bank either from the Abuja or Port Harcourt branches for the case before the court..

Speaking after the adjournment, Counsel to the claimant, Barrister George Halliday said his client was in the court to address the issue of non authorization of N151, 810, 932, 19 kobo from his account by Access bank.

Halliday said the case is a clear case for his client as the bank never sought approval from the claimant  before such huge sum of money was withdrawn from his account  and paid to the Bayelsa State Government account.

According to Halliday, his client’s account was tampered with by the management of Access Bank without the approval of his client and prayed the court to see that the money withdrawn was reversed to the claimant’s account and an award of N3 billion compensation from the bank.

Speaking to our correspondent after the adjournment, Godwin Sidi, Managing Director, Godsidi Investments, said when he noticed that his company’s account was tampered with by Access bank without his approval, he approached the court for action.

The claimant said he had lodged a complaint with the  Central Bank of Nigeria, CBN, Consumer Protection Council, CPC  and the Economic and Financial Crimes Commission, EFCC over the alleged withdrawal by the bank without his authorization.

He therefore prays the court to urge the defendant to reverse his money back into his account as well as pay him compensation for the illegal withdrawal and tampering with his account with the bank.

Counsel to the defendant, Access Bank, C.B Sigalo declined comment, saying that the case before the court and urged this reporter to approach the bank management for any comment.
